REAL ESTATE DISPUTES

Tom Kilpatrick has represented developers, REITS, and commercial landlords in a wide variety of real-estate disputes, including:


  • Contracts for the sale and purchase of real property, such as residential subdivisions, commercial developments, and residential houses;
  • Construction disputes and lien claims;
  • Ownership disputes between or among multiple property owners such as partitions in kind (dividing the land itself) and partitions by sale (selling the property and dividing the sale proceeds);
  • Commission/brokerage disputes;
  • Commercial landlord-tenant disputes; and 
  • Condemnation or eminent domain where land is taken by a state or local governmental agency or by utility company.  


In condemnation cases, Kilpatrick Law Group will only represent landowners faced with having their property involuntarily taken from them, or impaired by easements or partial takings.
